Preliminary Article: Definition of Contract Terms

For the purposes of these Terms and Conditions, the terms below shall have the following meanings:
“Client” refers to a natural person of legal age with full legal capacity at the time of entering into the reservation contract, or a legal entity duly represented by a natural person with the authority and legal capacity to act on its behalf.
“Hotel” refers to Hôtel de la Comète.
“Website” refers to the electronic service operated by HOTEL DE LA COMETE on the Internet and accessible at the address indicated in the preamble hereto.
“Booking Platform” refers to the electronic service connected to the Website that allows online reservations for Hôtel de la Comète.

I. Preamble

1. The company HOTEL DE LA COMETE (a limited liability company), registered under SIRET number 57215636200012, registered with the Paris Trade and Companies Register under number 572 156 362, with its registered office at 196 Boulevard de la Villette, 75019 Paris, and a share capital of €40,000.00, operates the following booking website: https://www.hoteldelacomete.fr
   
   This website presents Hôtel de la Comète and allows the reservation of rooms and related hotel services. These General Terms and Conditions of Sale apply to the Website mentioned above.
   
2. The Client acknowledges having all the necessary information to make an informed choice and complete their reservation on the Website. It is agreed that:
   ● These General Terms and Conditions apply to all reservations made on the Website of Hôtel de la Comète by individual clients.
   ● These Terms and Conditions do not apply to business customers who have entered into a specific contract.
3. Any reservation made through the Website implies full and unconditional acceptance of these General Terms and Conditions of Sale, as well as the specific conditions of sale applicable to the selected rate, expressly stated in the rate description at the time of booking.
4. Acceptance of these General Terms and Conditions and the rate conditions by the Client becomes final once the corresponding box is checked during the reservation process. No reservation may be made without such acceptance.
5. The Client acknowledges fully understanding these General Terms and Conditions, written in French and/or English, and confirms having the legal capacity to enter into this agreement.
6. The Website provides the following information:

7. The Client declares that the reservation is made strictly for personal use. As a consumer, the Client benefits from specific rights that would not apply if the services were reserved for non-personal purposes.
8. All information available on the Website, as well as these General Terms and Conditions of Sale, is provided in both French and English.

II. Purpose

1. These General Terms and Conditions of Sale define the rights and obligations of the parties in connection with reservations made via the Website of Hôtel de la Comète.
2. The Client acknowledges having read and accepted these General Terms and Conditions of Sale and the conditions of sale of the selected rate, which are accessible at all times on the Website, without reservation.

III. Duration

1. These General Terms and Conditions of Sale apply for the entire duration during which the services of Hôtel de la Comète are available online.
2. HOTEL DE LA COMETE reserves the right, without prior notice or compensation, to amend these General Terms and Conditions, to temporarily or permanently close the Website or the online booking platform. Clients are therefore encouraged to consult them regularly. The applicable Terms and Conditions are those in force on the date of the Client’s reservation. Any subsequent version shall not apply to reservations already made.
3. HOTEL DE LA COMETE shall not be held liable for any damage resulting from such modifications, temporary unavailability, or permanent closure of all or part of the Website or associated services.

IV. Reservation

1. The Client acknowledges having made the reservation with full knowledge of the facts and having obtained all necessary information. Room reservations are limited to natural persons of legal age with full legal capacity. By making a reservation, the Client expressly declares meeting these conditions.
2. The Client may reserve a maximum of four (4) rooms for the same date via the Website, for personal use only. Any reservation exceeding this number shall be subject to group booking conditions and excluded from these General Terms and Conditions. In such cases, the Client must contact the hotel’s sales department by email or telephone to obtain the applicable group booking conditions.
3. The Client is solely responsible for their choice of services and their suitability for their needs. HOTEL DE LA COMETE shall not be held liable in this respect.
4. The reservation is deemed accepted by the Client upon completion of the booking process.
5. All reservations are strictly personal and may not be transferred to a third party, whether free of charge or for consideration. Any reservation made on behalf of another person must be made in that person’s name.

V. Booking Process

1. The Client may reserve a room via the Website’s booking platform by clicking on the “Book” button.
2. The Client selects the dates of stay, number of guests, room type, additional services, and applicable rate.
3. The Client confirms their selection by clicking “Book” after reviewing the full description of the room(s) and included services.
4. The Client completes a form providing personal details and those of accompanying guests, and enters payment card details to guarantee payment upon arrival. The Client certifies the accuracy of the information provided.
5. The Client confirms the reservation after reviewing and accepting the General Terms and Conditions of Sale of the selected rate and the privacy policy.
6. The reservation is confirmed, and the Client receives a booking summary page and a confirmation email sent to the address provided.

VI. Cancellation or Modification Conditions

1. Non-cancellable and non-refundable rates cannot be cancelled or refunded under any circumstances.
2. Flexible rates may be cancelled or modified in accordance with the specific conditions of sale applicable to the selected rate.
3. Cancellation or modification may incur fees as specified in the applicable rate conditions.
4. To cancel or modify a reservation, the Client must contact the Hotel using the contact details available on the Website.
5. In the event of force majeure or inability to provide the reserved room, Hôtel de la Comète may offer a room of a higher category or accommodation in a hotel of at least equivalent category.
6. In accordance with Article L.221-28 of the French Consumer Code, the Client does not benefit from the right of withdrawal provided for in Article L.221-18.

VII. Stay at Hôtel de la Comète

1. Upon arrival, the Client may be required to complete a police registration form and present a valid identity document. Failure to present valid identification may result in cancellation of the reservation without compensation.
2. The Client agrees to use the room and common areas reasonably. Any behavior contrary to safety, hygiene, public order, or decency may result in immediate eviction without refund or compensation.
3. The Hotel has internal rules that the Client agrees to respect. Failure to do so may result in eviction without compensation.
4. Common areas and facilities are provided free of charge, unsupervised, and used at the Client’s own risk. Minors are not allowed without supervision.
5. Check-in is from 3:00 p.m. and check-out is before 11:00 a.m. Late departure will result in an additional night being charged.
6. Pets are not allowed.
7. Specific conditions may apply for stays longer than six (6) nights.

VIII. Guarantees

The Hotel is subject to the legal guarantee of conformity of services in accordance with Articles L.212-1 et seq. of the French Consumer Code.

IX. Liability

1. Any reproduction or use of content from the Website is strictly prohibited.
2. HOTEL DE LA COMETE shall not be liable for indirect damages, including those caused by third parties, Clients, or partners.
3. The Hotel declines any liability for internet-related risks, technical failures, or misuse.
4. Fraudulent or irregular reservations or payments will result in cancellation at the Client’s expense.

X. Prices

Payment methods accepted are indicated on the Website. Credit card details are required as
a guarantee. Payment is made upon arrival unless prepayment applies.

XII. Personal Data

Personal data is processed in accordance with applicable data protection laws. The Client has rights of access, rectification, opposition, and deletion.

XIII. Proof Agreement

Electronic records constitute valid proof of transactions and agreements.

XIV. Force Majeure

Neither party shall be held liable for non-performance due to force majeure as defined by
French law.

XV. Governing Law

These General Terms and Conditions are governed by French law.

XVI. Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties.

XVII. Amendments

These Terms and Conditions may be amended at any time and will apply to new reservations once published online.
